Fox News senior judicial analyst Judge Andrew Napolitano weighed in Tuesday on "Fox & Friends" on the constitutionality of proposed "red flag" laws to prevent potentially dangerosu people from buying guns in the wake of mass shootings over the weekend in El Paso, and Dayton.
"This was an adult, not a child," Napolitano said about one of the shooters who is reported to have made a "rape list" in high school. "I'm not defending his behavior, but honest law-abiding people should not lose their rights because some judge thinks they right do something in the future. That's the Soviet Union model, not the American model."
"Anything they can do to deter people from committing a crime is probably a good thing, as long as they don't violate the Constitution," Napolitano said.
